Sell a Rental Property in Florida

Selling · Landlords

To sell a rental property in Florida, you can sell with the tenant in place to an investor, or wait for the lease to end and sell vacant to any buyer.

Alex helps landlords compare both paths and handle showings the right way.

With tenants or vacant?

Tenant in place

  • Rent keeps coming in during the sale.
  • Buyers are mostly investors who want the income.
  • The lease generally continues with the new owner.
  • Showings depend on tenant cooperation.

Vacant

  • More buyers, including owner-occupants.
  • You can clean, repair, and stage.
  • You carry the costs with no rent.
  • You wait out the lease or agree on an early move-out.

What Florida law means for the sale

  • A sale generally doesn’t end an existing lease. The buyer takes the property subject to it.
  • Security deposits and advance rent transfer to the new owner at closing, and the tenant should be told who holds them.
  • Give the tenant proper notice before entering for showings, as Florida law and the lease require.
  • An early move-out has to be agreed on. Some landlords offer a voluntary “cash for keys” payment.

Talk to a Florida attorney before changing or ending a lease.

Thinking about a 1031 exchange?

If you want to reinvest the proceeds into another investment property, a 1031 exchange may defer federal capital gains tax. The planning has to start before you close the sale.

Helpful to have ready

  • The current lease and rent history.
  • The security deposit amount and where it’s held.
  • Recent repairs and any open maintenance issues.
  • Operating costs: taxes, insurance, HOA, and management.

Landlord questions

Do tenants have to allow showings?

Tenants generally must allow access at reasonable times with proper notice. Respecting their schedule gets better cooperation.

Can I end the lease early to sell?

Only if the lease allows it or the tenant agrees. A voluntary move-out agreement is often the smoothest route. Get legal advice on the terms.

Who is the best buyer for a tenant-occupied home?

Usually an investor who wants the rent. Alex presents the rent roll and lease terms so investors can evaluate the numbers quickly.
